Terms and Conditions
Article One: Definitions
The following terms and expressions shall have the meanings indicated opposite them unless the context requires otherwise:
1.1 Establishment: Ahmed Al Zamil Trading Establishment, Commercial Registration No. (1010537213).
1.2 Customer: The lessee based on the rental request received via any of the establishment's official communication channels.
1.3 Rented Property: The property rented pursuant to the rental request received from the customer via any of the establishment's official communication channels.
1.4 Product Brochure: A form or forms containing a list of the names, symbols, images, prices, and information about the products and services offered by the establishment.
1.5 Classification Table: A table of age, number, and weight classifications for players in games.
Article Two: Contract Data and Documents
2.1 This contract consists of the following documents and data:
2.1.1 The rental request submitted by the customer to the institution via any of its communication channels, including the type, quantity, and value of the leased property, the rental date and term, the delivery and receipt location (installation and disassembly), and the customer's contact numbers.
2.1.2 The product brochure or price quote submitted to the customer.
2.1.3 This basic contract document.
2.1.4 Appendix (1): Table of age classifications, numbers, and weights of players in the games.
2.2 These documents and data constitute a contractual and complementary unit, and everything contained therein is considered an integral part of this contract. The total value of this contract shall be in accordance with the request referred to in Article (2.1.1) and the prices in the product brochure.
Article Three: Conditions of Use of the Leased Property
The customer is bound by the following terms of use:
3.1 Inflatable rides (dry or water, including trampolines, slides, challenge rides, mazes, playgrounds, etc.):
3.1.1 The use of chains or strings is prohibited on inflated rides.
3.1.2 Players are prohibited from entering inflated rides wearing shoes, goggles, or any sharp objects such as pens, knives, or the like, or any other items that could cause collateral damage.
3.1.3 Consuming any food, drink, candy, or gum inside the ride is prohibited.
3.1.4 Conducting disruptive behavior while using the ride, such as flipping, tumbling, wrestling, roughhousing, climbing, sliding headfirst, or sliding two players at once, or any other behavior that could lead to injury, is prohibited.
3.1.5 Playing or jumping on the front of the rides or any of their parts (the threshold or outside areas) is prohibited.
3.1.6 Do not open the zippers of the inflatable rides while they are in operation.
3.1.7 The ride motors must be carefully monitored and cleaned of any obstructions, such as trees, leaves, bags, balloons, etc., which could reduce the ride's airflow.
3.1.8 Do not expose wires, tools, or electric motors to water or liquids.
3.1.9 All players must be removed during heavy rain, and the ride motors must be turned off.
3.1.10 Do not play on wet surfaces or near the ride's electrical equipment or other electrical entertainment devices.
3.1.11 All players must be removed from the ride immediately if the ride's electrical equipment goes out, whether intentionally or unintentionally, such as a power outage.
3.1.12 Do not move or transport the rides or electrical equipment from their locations after installation, except with the permission of a qualified technician.
3.1.13 Consider the weather conditions, wind speed, and wind strength before using inflatable rides.
3.1.14 Adult supervision is required for children 12 years of age and younger on rides designated for their age group according to the classification table.
3.1.15 Do not add water or soap to dry rides.
3.1.16 Do not expose rides to any form of heat or energy sources (such as fire, heaters, grills, electrical appliances that produce heat, large gas stoves, fuel, diesel, etc.).
3.1.17 The ages, numbers, and weights specified in the classification table must be adhered to.
3.2 Meltdown (D3) + Meltdown Plus (D4):
3.2.1 The customer must appoint a supervisor or fixed observer for the ride during its use.
3.2.2 Jumping or hanging on moving poles is prohibited.
3.2.3 Any harmful movements or actions, such as flips or acrobatics, are prohibited within the game.
3.2.4 It is prohibited to enter the game with shoes, glasses, mobile phones, keys, or any sharp objects that could cause harm to the player.
3.2.5 No one with any previous injuries or health concerns, or who is pregnant or under the influence of psychoactive substances, may participate in the challenge.
3.2.6 It is prohibited to use the game controller except the person in charge.
3.2.7 The game must be stopped completely each time all players fall, allowing the next group to enter.
3.2.8 It is prohibited to use the game if it becomes wet or rains.
3.2.9 The game must start at a slow pace to build player confidence. As the game progresses, the operator may increase the difficulty of the challenge.
3.2.10 The age, number, and weight limits specified in the ratings table must be adhered to.
3.3 Raging Bull (D2) and Survival Challenge (D49):
3.3.1 The customer must appoint a permanent supervisor or monitor for the game throughout its use.
3.3.2 The operator or supervisor must constantly monitor the player within the game.
3.3.3 Any harmful movements or actions, such as flips or any acrobatics, are prohibited within the game.
3.3.4 It is prohibited to enter the game wearing shoes, glasses, mobile phones, keys, neckwear, or any sharp objects that could cause harm to the player.
3.3.5 No one with any previous injuries or health concerns, or who is pregnant or under the influence of psychoactive substances, may play the game.
3.3.6 The use of the game controller is prohibited except by the person in charge.
3.3.7 The game must be stopped every time a player falls.
3.3.8 The game must not be used if wet or rainy.
3.3.9 The ages, numbers, and weights specified in the classification table must be adhered to.
3.4 Drowning Tank (D50):
3.4.1 The customer must appoint a permanent supervisor or observer for the game at all times.
3.4.2 The player must be at least 150 cm tall.
3.4.3 The player must be able to swim.
3.4.4 Food and drinks must be kept away from the tank.
3.4.5 Only one person is allowed to sit on the seat or in the tank at a time.
3.4.6 Standing on the seat is prohibited.
3.4.7 The player must sit upright, with their hands on their chest or knees.
3.4.8 Players must not hold onto the bars or place themselves or anything else through them.
3.4.9 No one shall be behind the tank or target area, except the supervisor or observer.
3.4.10 Players with physical or mental disabilities are prohibited from playing and must be kept away from the tank for their safety.
3.4.11 Players with chronic knee or other joint conditions, previous back or neck injuries, respiratory or heart conditions, or circulatory problems are prohibited from playing.
3.4.12 Only balls provided by the establishment must be used.
3.4.13 The customer must ensure that the tank is sufficiently filled with water.
3.4.14 The water inside the tank must be completely emptied at the end of play.
3.4.15 The ages, numbers, and weights specified in the classification table must be adhered to.
3.5 Outdoor Toys and Equipment:
3.5.1 Outdoor toys and equipment used for play purposes, such as balls, darts, rings, cans, and any other play equipment outside or inside the game area, must be under adult supervision, and care must be taken to ensure that they are not accessible to children without direct parental supervision.
3.6 Arcade Games (E1 to E37) and Electronic Devices:
3.6.1 The customer must appoint a game supervisor and operator before children can ride or play on any game.
3.6.2 The operator or supervisor must constantly supervise children inside the game.
3.6.3 Ensure that children and other persons do not enter the game area surrounding the following games (as named in the product manual): all trains, flying bees, and flying vehicles. It is prohibited to cross their tracks or attempt to disable them in any way for your safety and to avoid any collateral damage.
3.6.4 Avoid using the foam device if anyone has a soap allergy.
3.6.5 It is prohibited to leave the "snack" devices without direct customer supervision.
3.6.6 The operator or supervisor of the rides must be responsible for monitoring the metal operations used to operate the rides and ensuring that they are used for their intended purposes. The establishment disclaims liability for any damages resulting from improper use or negligence by the customer.
3.6.7 The ages, numbers, and weights specified in the classification table must be adhered to.
3.7 Pony:
3.7.1 It is prohibited to approach the rear of the horse. The horse must see you from the front. Riding must be from the sides, not the rear.
3.7.2 The pony is intended for players aged 8-10 only.
3.7.3 A constant escort must be present when children are with the pony.
3.7.4 The rider's weight must not exceed 45 kg.
3.7.5 The rider's height must not exceed 150 cm.
3.7.6 Feeding a horse is prohibited without consulting a specialist.
3.7.7 Do not walk your pony on tiles, ceramic tiles, or any other soft surface.
3.7.8 Do not hit or tease the horse in any way, as this may cause an unexpected reaction.
Article Four: General Provisions
4.1 The customer acknowledges that he has reviewed all the details of the leased property in the product brochure and found it fully complete and usable for the purpose for which it was rented.
4.2 Cancellation or Amendment of the Rental Application:
4.2.1 The customer may cancel the rental application at least (7) days prior to the agreed-upon installation date during holidays, school holidays, national holidays, and other official holidays, and at least (48) hours prior to other periods. The institution shall be entitled to the full amount if the reservation is cancelled in violation of the deadlines specified in this clause.
4.2.2 The customer may amend the rental application date, provided that this is done at least (7) days prior to the agreed-upon installation date during holidays, school holidays, national holidays, and other official holidays, and at least (48) hours prior to other periods. The new amended date must be convenient for the institution and in accordance with the dates available to it.
4.3 Handover and Receipt of the Leased Property - Installation and Dismantling:
4.3.1 The date and location of installation of the leased property shall be in accordance with the rental request contained in Clause (2.1.1) of this contract.
4.3.2 Installation times shall be from 11:00 AM to 8:00 PM. The customer may coordinate with the establishment and choose a suitable time within the establishment's available hours.
4.3.3 Dismantling times shall begin at 11:00 PM on the same day of rental or the last day of rental, as applicable, and may be extended until 2:00 AM at most.
4.3.4 The customer is obligated to enable the establishment's workers to retrieve the leased property according to the times specified in Clause (4.3.3). In the event of failure to do so, the customer shall be obligated to pay a total rental amount equal to the total rental amount for each day of delay.
4.4 The customer is obligated to inspect the rented property at the time of installation and ensure that it is free of defects and that it is in good condition and suitable for use. If any defects are found, the customer is obligated to notify the company immediately upon becoming aware of them. Failure to do so constitutes dissatisfaction with the defects.
4.5 The customer is obligated to select a suitable location for installation. The company is not responsible for any personal, financial, or material damages arising from the customer's choice of installation location.
4.6 The customer is obligated to provide water for the use of water games.
4.7 The customer is obligated to provide electricity to operate the games and all rented products.
4.8 The customer is obligated to obtain the necessary approvals for installation if the location is not owned by the customer, such as a rest house, chalet, or any other rented or non-customer-owned property. The company is not responsible for any refusal by the authorized person at the installation site, and the company is entitled to the full rental value in such cases.
4.9 Any agreement between the customer and the installation team regarding disassembly and installation times, price adjustments, location changes, rental property changes, or any other modifications shall not be valid. Any agreement on any of the above shall be made through the company's official communication channels.
4.10 The customer is obligated to return the rental property at the end of the rental period in the same condition as received, except for normal usage.
4.11 The images in the product brochure do not reflect the actual dimensions of the rental property. The dimensions in the brochure are the approved dimensions.
4.12 The customer is bound by the terms of use contained in this contract and is obligated to provide instructions to all players and monitor their progress.
4.13 The Foundation disclaims any liability for any injuries or accidents that occur after the completion of the installation and operation of the leased property. It also disclaims any liability for any injuries or accidents arising from the following:
4.13.1 Players' violation of the terms of use contained in this contract
4.13.2 Using the leased property for purposes other than its normal purposes
4.14 The invalidity of any provision, condition, or provision of this contract shall not affect the validity of the remaining provisions and conditions contained therein, unless such condition is essential and relates to the main purpose of this contract.
4.15 The interpretation and implementation of this contract shall be subject to the relevant laws, regulations, and decisions applicable in the Kingdom of Saudi Arabia.
4.16 In the event that either party to this contract disagrees—God forbid—regarding the interpretation of this contract or any provision or appendices thereof, the dispute shall be resolved amicably to the extent possible. If this is not possible within (30) days from the date of its inception, the dispute shall be referred to the competent court in the city of Riyadh, Kingdom of Saudi Arabia.
